TOPIC &#8211; The tragic death of 7 year old Katelynn Sampson and suggested inquest.<br />
INFO &#8211; In the wake of Katelynn Sampson horrific death in August 2008, Ontario passed legislation to ensure guardians in child custody cases provide police record checks, clearance from Children’s Aid, and show they are able to care for the child.</p>
<p>Local Children’s Aid Societies have strengthened procedures.<br />
But Ontario Child Advocate Irwin Elman says an inquest is still needed to understand exactly what went wrong and what more can be done to prevent such tragedies.</p>
<p>&#8220;Where did we as a province fail Katelynn and this family?&#8221; Elman said Wednesday.<br />
The Coroner’s office has not yet made a decision on an inquest.<br />
Katelynn died after prolonged abuse while in the care of her unemployed, crack-addicted legal guardians. An autopsy showed the 7-year-old had 70 wounds when she went into septic shock.</p>
<p>On Tuesday, those guardians, Donna Irving, 33, and her boyfriend, Warren Johnson, 50, pleaded guilty to second-degree murder and were sentenced to mandatory life imprisonment with no parole eligibility for 15 years.</p>
<p>But at a broader level, Elman says all children need meaningful relationships with caring adults, and he hopes an inquest will look into that more &#8220;human problem.&#8221;</p>
<p>&#8220;It’s not a rule you can make. But it doesn’t mean we shouldn’t challenge ourselves to figure out how to do it,&#8221; he said.</p>

According to medical evidence, Katelynn was already suffering horrific physical abuse when Ontario Court Justice Debra Paulseth legally sanctioned her living arrangement with Irving and Johnson on June 6, 2008.</p>
<p>Irving called the Toronto Children’s Aid Society in March 2008 to say she did not think she could provide for Katelynn and wanted her gone. The agency passed the case on to Native Child and Family Services — Katelynn is half Anishinabe — which eventually closed the case at Irving’s request, after she lied and told a social worker she was receiving help from Katelynn’s school.</p>
<p>Later, Katelynn’s school principal reported bruises and burn marks to Children’s Aid, which passed the case again to Native Child and Family Services.</p>
<p>In an interview with the Star, the executive director of Native Child and Family Services said his agency never received that referral. He also said case workers had no authority to investigate Irving after the March 2008 phone call because it was a voluntary call and there was no evidence of abuse at that time.</p>
<p>Rules have since been tightened — supervisors must now sign off before cases are closed and receipt of referrals must be confirmed — but when it comes down to it, Kenn Richard says his employees did all they could.</p>
<p>&#8220;We had extensive investigation and internal reflection on this ourselves and I am satisfied that my staff did, certainly, everything that’s required under our charter as a Children’s Aid Society,&#8221; he said.</p>
<p>&#8220;I would welcome (an inquest) so that we can all share what we believe went on, the roles that were played by the various institutions — and there were many players — so that we can craft some intelligence here that will make our system better at protecting kids like Katelynn.&#8221;</p>
<p>David Rivard, executive director of the Toronto CAS, said his agency provides after-hours emergency services for Native Child and Family Services and is legislatively bound to pass cases involving aboriginal children to them.</p>
<p>But he acknowledged the case prompted all four Toronto Children’s Aid Societies to move to a computerized referral system and to adopt tighter protocols.</p>
<p>Although confidentiality prohibits Children’s Aid Societies from disclosing what action, if anything, is taken after schools and other community partners report concerns about children at risk, more could be done, he said.</p>
<p>&#8220;As a sector we are looking at how we can work more closely with those other sectors to ensure when they are making a referral, follow-up is provided to them. That they know we are investigating,&#8221; he said. &#8211; The Toronto Star</p>

I remember the first time I sat around a kitchen table in a rural community giving environmental law advice. I was speaking with a farmer who was beset by pollution running across his fields and destroying his fish and hunting camp along the Rideau Canal.</p>
<p>The family had asked my law firm what we could do about the landfill leachate from a major Ontario city dump that was destroying habitat. No one from the City, the waste company or government had offered to help them. Now everyone in the room — his wife and mother at the wood stove, his sons and daughters and grandkids around the table — was keenly awaiting what I had to say.</p>
<p>I asked: Are there any fish in the fields, ditches or nearshore? The family told me the bay was once the best fishing area around and that fish still spawned in the fields and ditches every spring.</p>
<p>I asked: Can I get access to the water draining from the dump to sample as it runs onto your land? The family told me the exact locations where the water bubbled up on the dump walls and ran year-round onto their property.</p>
<p>I answered: I can help.<br />
We documented the fish in the ditches and the bay. We sampled the leachate (it was toxic). We contacted government authorities and the company, alerting them that we had evidence the dump was in contravention of the Fisheries Act. Immediately, they took action to stop the pollution. To this day, that area on the river is protected from landfill toxins.</p>
<p>My story is not unique. It has been played out across Canada thousands of times. When evidence of a Fisheries Act contravention was compiled, the harmful acts were almost always stopped.</p>
<p>Even when government or industry did not act, the Fisheries Act allowed citizens to enforce the law independently. In fact, the Fisheries Act says that, if convicted, a polluter pays half of the fine to the individual who brought the charges. This is meant to “encourage the public to participate in the protection of community resources.”</p>
<p>Such citizen-led actions form an important part of Canada’s environmental protection laws. In the past 16 years, I have personally been involved in investigating legal actions against the Cities of Kingston, Hamilton, Moncton, Montreal, and Toronto as well as the Ontario Ministry of Environment, Ontario Hydro, OPG, DTE and other polluters for Fisheries Act violations. That work resulted directly or indirectly in clean-ups on the Cataraqui River, Humber River, Moira River, Petitcodiac River, St. Clair River, Lake Ontario, St. Lawrence River and other waters across Canada.</p>
<p>All of this was possible because the Fisheries Act made it illegal to pollute or destroy fish and fish habitat in Canada. The offenses under the Act were criminal in nature, meaning enforcement was free from political interference or economic lobbying by industry. The laws protected every community, regardless of the size of the project, the abundance of fish, or the “economic value” of nature.</p>
<p>That is all about to be wiped out. The budget implementation bill that Parliament is considering now radically changes the Fisheries Act. Under the new law, cabinet ministers and industry will have unprecedented influence over fish and fish habitat policy.</p>
<p>Under the new law, decisions about which Canadian communities deserve protection will be made based on political and economic factors. There is no role for science or the rule of law.</p>
<p>The consequences of the changes will be felt immediately. Will Lake Ontario’s fish be protected? Or will our small commercial fishery be deemed “insignificant”? Will we see sewage treatment plant upgrades in Vancouver, Victoria, or Halifax? Or will environmental benefits be deemed “insignificant” in light of the cost? Clean-ups like the ones we saw at the dumpsite beside the farmers field will most certainly be things of the past.</p>
<p>When I read about the changes, I know that every farmer, hunter, angler, and community member who loves access to swimmable, drinkable, fishable waters will lose out.</p>
<p>I know that, if I was a young environmental lawyer sitting at that kitchen table today, I wouldn’t be able to offer the same help I did all those years ago to the farmer and his family. That breaks my heart. Mark Mattson</p>

TOPIC &#8211; Toronto Railway Museum and meeting with Toronto Hydro. TRHA Frustrated by Utility’s Reversal of Promise on Roundhouse Machine Shop.</p>
<p>INFO &#8211; Summary of TRHA’s alternative proposals for the Machine Shop:<br />
Since April 2011, the TRHA has been trying to work with Toronto Hydro and their engineers to develop alternatives which would allow for the continued use of the Machine Shop by the TRHA for the establishment of the Toronto Railway Museum as well as the design and construction of the Bremner transformer station to allow Toronto Hydro to meet the electrical requirements of the City of Toronto and contribute to the renewal of their existing facilities. In short, the TRHA has consistently worked towards a solution which would truly be mutually beneficial and we have provided viable alternatives to Toronto Hydro to that end.</p>
<p>The first option proposed by the TRHA makes use of a parcel of land which is immediately adjacent to the proposed transformer station site and we have been meeting with the City of Toronto Real Estate and Facilities Management Services, since July 2011, to facilitate the transfer of this additional land to Toronto Hydro for their future capacity and use through a “lease-to-own” scheme. This option would allow for the construction of the transformer station below-grade as originally proposed by Toronto Hydro.</p>
<p>The use of this additional land could provide Toronto Hydro with up to 74,000 sq.ft. of additional space for its current proposal and any future expansion needs. Although the land is currently subject to multiple easements, the City of Toronto has indicated that they are willing to work with the TRHA and Toronto Hydro to remove or mitigate existing easements.</p>
<p>It is important to note that this land will have little value once the transformer station is constructed as it will be bordered by the transformer station to the west, the Metro Toronto Convention Centre to the north and east and Lakeshore Boulevard to the south.</p>
<p>The TRHA also proposed that Toronto Hydro locate those elements currently housed within the Machine Shop in a one storey, above-grade structure which could be incorporated into the above-grade structure currently proposed for the exhaust and ventilation shafts at the southwest corner of the transformer station site. This option would allow Toronto Hydro to maintain their parking and access to the station distinct from the other businesses and facilities on the site and would, again, avoid the extremely detrimental measures that Toronto Hydro is currently proposing for the historic fabric of the Machine Shop.</p>
<p>Those elements currently proposed for the above-grade space within the Machine Shop are physically distinct from the remainder of the transformer station below grade: the relocation of these elements does NOT constitute a major design change and most certainly does not jeopardize the project. Toronto Hydro has stated that the project is too far advanced to allow for any revision. The TRHA originally proposed these options to Toronto Hydro in July 2011 but no effort was made to consider our alternatives although the transformer station design, to our knowledge, has not been finalized. Toronto Hydro has stated repeatedly that they have invested too much capital to date to consider alternatives. The TRHA rejects that argument and notes that this is a situation of Toronto Hydro’s own making.</p>

Sylvia Jones MPP, Dufferin-Caledon expressed concern with the decisions. “Four partial days of hearings is not sufficient to allow for meaningful public participation,” Jones said. “In the last election the McGuinty Liberals promised that an in-depth review would<br />
take place and that there would be ample opportunity for public participation.” “Clearly the Liberal Government has broken this promise, and I am concerned that municipalities, industry representatives and residents most familiar with aggregates, residing in communities where aggregate extraction occurs, will be left out of the process.”<br />

Ontario Provincial Police (OPP) Commissioner Chris Lewis addressed the media at Lake Couchiching waterfront today to talk about boating safety as OPP marine officers from across the province trained nearby on brand new vessels being added to the OPP&#8217;s marine fleet this spring.</p>
<p>The OPP Fleet, Supply &#038; Weapons Services Bureau (FSWSB) is replacing some of its older police vessels with 27 modern, new vessels that have been specially designed to carry out law enforcement duties.</p>
<p>The new &#8220;Justice&#8221; series vessels, manufactured by Brunswick Boat Group consist of 17 21-foot Boston Whalers with single 300 hp. 4-stroke engines and ten 24-foot Boston Whalers with dual 200 hp. 4-stroke engines. The boats are being distributed among the OPP&#8217;s six regions and will be seen on Ontario lakes and rivers this coming season.</p>
<p>&#8220;The OPP has approximately 380 marine officers who police over 94,000 square kilometres of waterways in Ontario and these new police vessels will improve operational readiness for the difficult Search And Rescue (SAR) operations they carry out every year,&#8221; said Lewis.</p>
<p>With the May Long Weekend and Safe Boating Week less than three weeks away, Lewis said the training event was an excellent opportunity to deliver important safety messages about wearing personal floatation devices (PFDs), not mixing boating with alcohol or drugs, ensuring that boats and equipment are in good working order and other safety measures he wants boaters to adhere to this coming boating season.</p>
<p>A total of 22 people lost their lives in 18 boating incidents in OPP jurisdiction last year (2011) and according to Lewis, most of the deaths could have been prevented had people respected Ontario&#8217;s marine laws and exercised common sense on the water.</p>

INFO &#8211; The Canadian Anti-Fraud Centre says it received …..  complaints in 2011 related specifically to phishing and identity theft, where those registering the complaint lost money. The agency says 95 per cent of incidents go unreported, so the real number of victims may be closer to 27,000.</p>

The CAFC is a joint operation of the Royal Canadian Mounted Police, Ontario Provincial Police and Competition Bureau and monitors online fraud. OPP Det. Con. John Schultz, who works with the agency, says your best defence is to delete the email, invest in good anti-virus software and never give up personal information.</p>
<p>He points out that banks will never contact you by email and ask for account numbers or passwords.<br />
“If you’re in doubt, call the bank or drop into a branch,” he says.<br />
Banks scan the web continuously looking for fraudulent use of their trademarks. They are also part of a global network that works with Internet service providers to shut the fake sites down.</p>

If something unusual lands in your inbox here are the red flags:<br />
1. Accounts and passwords: Banks already know your account numbers. Why would they ask you to confirm them? Scotiabank’s Andrew Chornenky urges customers to report phishing attempts to the bank’s security operations at phishing@scotiabank.com. You can also report them to the CAFC via info@antifraudcentre.ca.</p>
<p>2. Immediate action: A message that asks you to act now is hoping the sense of urgency will overcome your suspicions. It is often accompanied by some kind of threat that an account will be closed or purchase rejected.</p>
<p>3. Poor use of language: Awkward grammar, misspellings and bad syntax are dead giveaways. The PayPal email had tenses wrong. It said: “On 16 Apr. 2012, your credit card has been removed from your PayPal account.”</p>
<p>4. Long web addresses: Companies keep web addresses simple so they’re easy for you to remember. These web and email addresses were long and awkward.</p>
<p>5. Wrong look and feel: The fake Scotia site had links to Scotia products, used the same red logos and reproduced the bank’s look and feel. But it wasn’t quite right. The more carefully you look, the more apparent the flaws.</p>
<p>The phishing losses reported to the CAFC tend to be small. The average loss is $570 and the good news is that credit card companies usually absorb the loss, cancel the card and issue you a new one. But even so, the best outcome is take steps to avoid the problem in the first place.</p>

TOPIC &#8211; Canadian shoppers pay more for products because suppliers charge Canadian retailers more – between 10-50 per cent more.</p>
<p>INFO &#8211; “Retailers play a very small part in determining final prices of goods they sell,” Diane Brisebois, CEO and president of the Retail Council of Canada (RCC), told a Senate Committee on National Finance on Tuesday morning.</p>
<p>The Senate committee began looking into pricing in October, following complaints from consumers tired of paying more in Canada for the same products sold in the U.S. The two currencies have been trading roughly at par for years.</p>
<p>And a survey from the Conference Board of Canada found that Canadians remained cautious about making large purchases in April. After three consecutive months of increases, the index fell to 75 in April, down 4.5 percentage points from a surprisingly positive March.</p>
<p>It all adds up to a tough 2012 for Canadian retailers, who are not optimistic about sales growth this year, according to the report from the RCC presented to the senate committee in Ottawa.</p>
<p>A survey of the 70 biggest RCC members found most expect growth of two to three per cent this year. With inflation expected to be in the two per cent range, the growth in actual volume of sales would be minimal.</p>
<p>The report gave examples of items sold by suppliers at different price points in Canada and the U.S.<br />
Ibuprophen 200 mg, sells to U.S. retailers for $10.76 and to Canadian retailers for $18.29, a difference of 70 per cent. A bottle of Aspirin 81 mg low dose sells to U.S. retailers for $10.16, and to Canadian retailers for $21.78, a difference of 114 per cent.</p>
<p>Canadian retailers say their suppliers tell them they charge more because Canadians are used to paying more for products in Canada; because the higher prices subsidize the costs of maintaining offices and operations in Canada, and because they have to compensate their Canadian distributors and wholesalers.</p>
<p>The RCC report also blamed tariffs on finished goods like some clothes, pantyhose, wooden bedroom furniture, bed linens, towels and pillows, for putting Canadian retailers at a competitive disadvantage with their U.S. peers.</p>
<p>The recent increase in personal exemption limits for Canadians travelling outside the country will also hurt retailers at home and ultimately, the Canadian economy, the report says.</p>
<p>The RCC also cited supply management for the high prices for eggs, chicken, butter and milk in Canada, which sends residents of border towns to the U.S. for groceries.</p>
<p>“It is the RCC’s position that the government should not favour one industry over another, in this case farmers over retailers, to the detriment of the latter,” it concluded.</p>
<p>Bill Mitchell, spokesperson for the Dairy Farmers of Ontario, said the idea that the marketing boards are responsible for the price difference in milk between Canada and the U.S. is false.</p>
<p>Border towns keep the price of milk artificially low to draw shoppers from Canada. Farms in the U.S. get federal and state subsidies that keep prices artificially low.</p>
<p>“We hope that the material we provided will help to set the record straight as to the real reasons behind the differences in pricing between Canada and the United States,” said Karen Proud, VP, federal government relations at the RCC.</p>
<p>The retail sector is the largest employer in Canada, providing jobs for more than 2 million Canadian and generating sales in excess of $300 billion dollars a year. It contributed $74.2 billion to Canada’s gross domestic product (GDP) in 2009.</p>

INFO &#8211; KENTVILLE — The door could soon be shut on large-scale wind turbine development in Kings County, at least for now.</p>
<p>The planning advisory committee for the Municipality of the County of Kings has passed a motion recommending further review of wind turbine issues. The committee also recommended that large-scale projects not be permitted in the meantime.</p>
<p>Council has not yet approved the motion. A public meeting has been set for May 10 at 5 p.m. in council chambers.<br />
The existing wind turbine bylaw, which was approved last year and allows large-scale wind turbine development, will be amended to ensure development permits are not issued.</p>
<p>The move comes in response to strong opposition from residents near South and North mountains, areas where two large-scale wind turbine developments have been proposed by Scotian WindFields and Acciona, a large multinational wind farm operator based in Spain.</p>
<p>Both groups of residents have lobbied council and presented petitions to the committee and council.<br />
“We are drafting amendments for a new policy that will replace the existing” one, said Warden Diana Brothers.<br />
There is still a window where a company could apply for a permit until the amendments take effect, Brothers said.<br />
Before changes can be put in place, the proposed amendments must be advertised, a public meeting must be held, and council must approve first and second readings.</p>
<p>That process would take until May 24, according to the process the county has planned.<br />
The changes would stall any applications for permits until a full review is completed, Dick Killam, councillor for part of the North Mountain area, (902 679 1949) said in an interview Saturday.</p>
<p>“If everything goes accordingly, permits would no longer be able to be issued as of May 24,” said Killam.<br />
He lives in Halls Harbour and opposes the proposal for a wind farm on North Mountain that could see 20 to 30 large-scale wind turbines from Arlington to the West Black Rock Road.</p>
<p>Killam made the motion to the committee to change the bylaw and put permits on hold.<br />
“That was my worry, that somebody would come in the back door and there would be nothing we could do to stop it. There was a definite sigh of relief after that meeting. The key thing was making sure nobody got in under the old policy. Now we just have to make to it May 24.”</p>
<p>The amendments to the bylaws would put off large-scale wind development for as long as council is reviewing the issue, he said.</p>
<p>Residents of North Mountain presented a petition to county officials with over 1,000 names opposing the Acciona development. The residents also asked that any wind turbine policy include a 2.5-kilometre setback from any home, a move that could effectively kill many wind farm proposals.</p>
<p>The setback under the existing policy is 700 metres.<br />
Many councillors are concerned about the proposed developments, Killam said.<br />
“I think the majority of us want to do the right thing. It’s a huge issue.”<br />
A recent health and safety report on wind turbines commissioned by council highlighted several uncertainties, he said.<br />
“There are new things coming out all the time in relation to the negative aspects.” </p>

INFO &#8211; AFGHANISTAN (April 23, 2012) — Today, Dave Toycen visited World Vision’s Neo-natal Unit in an Afghan maternity hospital and saw a newborn’s life being saved. While in Afghanistan this week, Toycen, World Vision Canada’s president, is meeting with children, families, community leaders and CIDA representatives about child and maternal health – a top priority for the Canadian government. With the highest rate of maternal mortality in the world and the second highest rate of child mortality, Afghanistan is ground zero for this issue.</p>
<p>Here’s what Dave Toycen had to say from Afghanistan:<br />
“Today I saw Afghans saving lives. At the neo natal unit we saw a life saved and I can understand why the mortality rate is so high in this country – this story of survival was an exception. While I was talking to a doctor at World Vision’s Neo-natal Unit a nurse brought in a newborn baby boy who had stopped breathing and turned blue. The team worked desperately to resuscitate him, one of 20 resuscitations they would attempt today. Forty-five seconds seemed like minutes on end, before the little guy took a breath and began to cry. I was shocked at how quickly it happened and was reminded how fragile life is—especially for babies in a country where one in five children doesn’t live to see a fifth birthday.”</p>
<p>“It’s not one thing that’s going to save the lives of children and mothers. You need functioning equipment, skilled doctors and nurses as well as community involvement. Today I was reminded how critical trained midwives are. While visiting a neo-natal clinic at the Herat Maternity Hospital I met young women who are training to be midwives and plan to return to their communities—they will have a profound impact on death rates.”</p>
<p>“Our government must keep placing child and maternal health at the top of its priority list. We know that the US will focus on food security and nutrition next month at the G8 Summit. This all ties together with child and maternal health—without enough nutritious food to eat, mothers and children don’t stand a chance.”</p>
<p>“Unfortunately, what we hear of most about Afghanistan is violence and poverty; but actually for a lot of women and families in this country life still goes on and they face all sorts of other challenges, including rampant malnutrition and a marked lack of health infrastructure.”</p>
<p>“Given all of these hurdles there is still some real progress being made and Afghans continue to hope even while up against some of the worst odds when it comes to the survival of children, mothers and families.”</p>

INFO/ BIO &#8211; Dr. MacFarlane is an Assistant Professor of Pediatrics and Psychiatry, University of Toronto. He was granted his doctorate from McMaster University Medical Centre for his work in neuropharmacology and began his sleep career at the Toronto Western Hospital in 1989. He also is a Research Associate at the Hospital for Sick Children in Toronto and is a consultant at the Niagara Sleep and Snoring Centre. He currently serves on the Board of the Canadian Sleep Society. Dr. MacFarlane is actively involved in developing innovative sleep educational programs for sleep technologists, medical students and physicians. He also provides public lectures to enhance awareness of issues related to sleep and sleep disorders.</p>

TOPIC &#8211; Toronto Railway Museum Future Derailed by Toronto Hydro. TRHA Frustrated by Utility’s Reversal of Promise on Roundhouse Machine Shop.</p>
<p>INFO &#8211; Toronto, April 20, 2012 —The Toronto Railway Historical Association (TRHA) has appealed directly to the President and CEO of Toronto Hydro-Electric System Limited to enter into good faith discussions with the TRHA over the future of the Roundhouse Machine Shop which, since 2001, has been intended to house Toronto’s Railway Museum.</p>
<p>The Machine Shop, an integral part of the historic Roundhouse located in Roundhouse Park on Bremner Boulevard, constitutes the only remaining space available to the TRHA on this National Historic Site to fulfill its mandate, as directed by the City of Toronto, of establishing the Toronto Railway Museum. The museum will tell the story of Toronto’s rail history through a display of artifacts and images, will include a learning centre with extensive archives, research library and school tours lecture space and will feature simulators which will allow visitors to drive a diesel locomotive through the rail lands as they were in the 1950’s.</p>
<p>In 2008, Toronto Hydro announced its intention to construct a transformer station on the north-west portion of the Roundhouse Park immediately below the Machine Shop. At that time, Toronto Hydro stated that the transformer station would be an unmanned, underground station with the Machine Shop made available for museum purposes. The TRHA and the City of Toronto dealt with Toronto Hydro on that basis, however, in November, 2011, the utility reversed its position and declared that the transformer station would occupy 60% of the Machine Shop above grade and that any remaining space would only be made available to the TRHA on a number of occasions throughout the year and at the discretion of Toronto Hydro.</p>
<p>“This situation constitutes a complete reversal of the previous position of Toronto Hydro, not to mention a complete lack of transparency. Previous Toronto Hydro President and CEO David O’Brien supported and encouraged our plans for Toronto’s Railway Museum, however, current CEO Anthony Haines has refused to meet with us to discuss possible alternatives,” said Orin Krivel, president of the Toronto Railway Historical Association. “We have been forced to deal repeatedly with their engineers rather than have meaningful discussions with the head of Toronto Hydro to arrive at a solution that preserves the Machine Shop for future museum use and clears the way for the transformer station.</p>
<p>“To date over $22M dollars have been invested in the restoration and development of Roundhouse Park by the City of Toronto and State Development. Our TRHA volunteers have put in over 50,000 hours of work, including the restoration of rolling stock and associated rail buildings as well as the construction and operation of the miniature railway,” said TRHA Project Spokesperson Glenn Garwood. “We understand and appreciate that Toronto Hydro must satisfy current and future electrical power requirements and, in that spirit, we have proposed two reasonable alternatives for their consideration. They have completely ignored our attempts to discuss these further with them.”</p>
<p>The TRHA contends that the loss of the Machine Shop space eliminates the potential for revenue generation, which would allow the Railway Museum to be self-sufficient and sustainable. It will also adversely affect both proposed and current programs and attractions and will destroy the possibility for a dynamic institution that would provide the opportunity for volunteer and community involvement, public and private partnerships, educational and vocational training opportunities and research activities and a major destination for tourists and residents alike.</p>
<p>“If we lose the Machine Shop we lose the opportunity to complete a much needed attraction and to tell the story of Toronto’s rail history. It means we negate all the time, money, hard work and effort that have been invested in that site for more than a decade,” said Krivel. “We cannot allow Toronto Hydro to dictate the manner in which this site is managed, especially when there are acceptable alternative proposals for them to consider. There is simply too much at stake.”</p>
<p>Note to Editors: Representatives of the TRHA will be available for interviews today, Friday, April 20 in the TRHA’s maintenance bays at the Roundhouse (immediately to the west of Steamwhistle Brewery) from 11:00 a.m. to 2:00 p.m. The miniature railway and the refurbished turntable, complete with operating locomotive, will also be in operation at that time.</p>
<p>Summary of TRHA’s alternative proposals for the Machine Shop:<br />
Since April 2011, the TRHA has been trying to work with Toronto Hydro and their engineers to develop alternatives which would allow for the continued use of the Machine Shop by the TRHA for the establishment of the Toronto Railway Museum as well as the design and construction of the Bremner transformer station to allow Toronto Hydro to meet the electrical requirements of the City of Toronto and contribute to the renewal of their existing facilities. In short, the TRHA has consistently worked towards a solution which would truly be mutually beneficial and we have provided viable alternatives to Toronto Hydro to that end.</p>
<p>The first option proposed by the TRHA makes use of a parcel of land which is immediately adjacent to the proposed transformer station site and we have been meeting with the City of Toronto Real Estate and Facilities Management Services, since July 2011, to facilitate the transfer of this additional land to Toronto Hydro for their future capacity and use through a “lease-to-own” scheme. This option would allow for the construction of the transformer station below-grade as originally proposed by Toronto Hydro.</p>
<p>The use of this additional land could provide Toronto Hydro with up to 74,000 sq.ft. of additional space for its current proposal and any future expansion needs. Although the land is currently subject to multiple easements, the City of Toronto has indicated that they are willing to work with the TRHA and Toronto Hydro to remove or mitigate existing easements.</p>
<p>It is important to note that this land will have little value once the transformer station is constructed as it will be bordered by the transformer station to the west, the Metro Toronto Convention Centre to the north and east and Lakeshore Boulevard to the south.</p>
<p>The TRHA also proposed that Toronto Hydro locate those elements currently housed within the Machine Shop in a one storey, above-grade structure which could be incorporated into the above-grade structure currently proposed for the exhaust and ventilation shafts at the southwest corner of the transformer station site. This option would allow Toronto Hydro to maintain their parking and access to the station distinct from the other businesses and facilities on the site and would, again, avoid the extremely detrimental measures that Toronto Hydro is currently proposing for the historic fabric of the Machine Shop.</p>
<p>Those elements currently proposed for the above-grade space within the Machine Shop are physically distinct from the remainder of the transformer station below grade: the relocation of these elements does NOT constitute a major design change and most certainly does not jeopardize the project. Toronto Hydro has stated that the project is too far advanced to allow for any revision. The TRHA originally proposed these options to Toronto Hydro in July 2011 but no effort was made to consider our alternatives although the transformer station design, to our knowledge, has not been finalized. Toronto Hydro has stated repeatedly that they have invested too much capital to date to consider alternatives. The TRHA rejects that argument and notes that this is a situation of Toronto Hydro’s own making. -30-</p>

<p>INFO &#8211; QUEEN’S PARK April 17, 2012- Candy flavoured and brightly packaged, flavoured tobacco blends in easily with more kid-friendly treats.</p>
<p>But this could change in Ontario, where a comprehensive ban on flavoured tobacco products was introduced today by NDP Health and Long-Term Care Critic France Gélinas.</p>
<p>&#8220;These products target kids; the flavours appeal to them and the packaging makes them easy to hide from parents,&#8221; Gélinas said. &#8220;They’re priced so that it’s easy for teens to buy one, just to try it, and then get hooked. Most teens wouldn’t spend $8 on a pack of cigarettes if they’ve never smoked, but might spend $1 just to try one. It makes tobacco extremely accessible.&#8221;</p>
<p>In 2008, Gélinas introduced a private member’s bill that banned the sale of individually packaged flavoured cigarillos. However, by the time the ban was implemented, tobacco companies had found loopholes and were able to continue selling a nearly identical product without running afoul of the original ban.</p>
<p>&#8220;This new ban will cover all flavoured tobacco products, including smokeless tobacco,&#8221; Gélinas said. &#8220;These sorts of products appeal to few adults; their intended market is young people. The goal of the bill is to protect our youth from becoming the next generation of smokers.&#8221;</p>

<p>TOPIC &#8211; Office of the Integrity Commissioner, and the role of the Integrity Commissioner in promoting public confidence in the integrity of each Member of Provincial Parliament and the public service, and maintaining the respect in which society holds the Legislative Assembly, its members and the public service.</p>
<p>INFO &#8211; Office of the Integrity Commissioner was founded in 1988 to provide conflict of interest advice to MPPs. Additional mandates were added over the years.</p>
<p>MPP INTEGRITY<br />
The Integrity Commissioner advises Members of Provincial Parliament on conflict of interest and ethical behaviour in their day to day activities. The goal is to prevent improper conduct before it occurs. The Commissioner offers MPPs guidance on such issues as balancing public and private interests, advocacy on behalf of constituents, participation in charitable events, constituency activities and more.</p>
<p>The Commissioner reviews each MPP’s annual financial disclosure statement, meets annually with each member to discuss the details, and publishes some of this information online.</p>
<p>The Members’ Integrity Act, 1994 sets out the standards of conduct and also gives the Commissioner the power to investigate one MPP’s complaint about another.</p>
<p>MINISTERS’ STAFF ETHICAL CONDUCT<br />
The Integrity Commissioner is the ethics executive for Ministers’ staff and considers questions on conflict of interest rules as they apply to work life, personal activities, and political activity. The Commissioner also advises staff on employment restrictions when they leave government. These responsibilities are found in the Public Service of Ontario Act, 2006.</p>
<p>LOBBYISTS REGISTRATION<br />
The Office of the Integrity Commissioner maintains an online public record of paid lobbyists, offering easy access to information on who is lobbying whom in the provincial government, and about what. The data base is searchable, and outlines each lobbyist’s name, company, client, the lobbying activity and the targeted ministry or agency. These responsibilities are outlined in the Lobbyists Registration Act, 1998.</p>
<p>EXPENSES REVIEW<br />
Cabinet Ministers and Opposition Leaders<br />
The Integrity Commissioner reviews the expenses of cabinet ministers, parliamentary assistants, opposition leaders, and their staff. The Commissioner determines whether the expenses meet the criteria set out in the Cabinet Ministers’ and Opposition Leaders’ Expenses Review and Accountability Act, 2002. Questions are directed to the claimant, and the government is reimbursed for any claims that are found to be in breach of the criteria.</p>
<p>Public Sector Expenses<br />
The Integrity Commissioner reviews the expenses incurred by senior staff and directors at the largest public agencies, boards and commissions in Ontario. The review follows a framework similar to that for government ministers and opposition leaders. Any disallowed claims must be repaid. This responsibility is outlined in the Public Sector Expenses Review Act, 2009.</p>

DISCLOSURE OF WRONG DOING<br />
The Integrity Commissioner has the responsibility for receiving disclosures of wrongdoing from current and former public servants. The details are received in confidence, and the Commissioner can direct that a senior official within the Ontario government launch an investigation. The Commissioner reviews the government response, and has the power to seek more information, make recommendations or – if dissatisfied with the response – conduct a new investigation.</p>
<p>The Commissioner follows the framework set out in the Public Service of Ontario Act, 2006.</p>

<p>INFO -The homes already face serious complaints and must prove they can care for seniors before getting one of Ontario’s new retirement-home licences, says Mary Beth Valentine, CEO of the Retirement Homes Regulatory Authority.</p>
<p>As of April 15, all retirement homes in Ontario — roughly 700 — must apply for an operating licence under rules set out by the new Retirement Homes Act. They cannot operate without a licence.</p>
<p>&#8220;We certainly have a number of homes that we would consider to be in a high-risk category,&#8221; Valentine said. &#8220;They will certainly be getting an inspection before a licensing decision is made.&#8221;</p>
<p>Created in January 2011, the authority started accepting complaints related to abuse or risk of harm a few months later. It has since investigated 150 homes. Valentine said the 50 in question have unresolved problems related to multiple complaints.</p>
<p>At least 40,000 Ontario seniors live in retirement homes; that number is expected to increase dramatically as the baby boomer generation ages. Homes range from expensive buildings that resemble luxury hotels, charging more than $6,000 a month, to low-cost houses that charge $1,200 a month.</p>
<p>Seniors’ Minister Linda Jeffrey said the new licensing system will put negligent operators on notice.<br />
&#8220;They would be at the top of my list (for investigations),&#8221; Jeffrey told the Star.<br />
&#8220;Our seniors have the right to expect they are going to be safe and comfortable and treated with dignity in their retirement. I would expect the retirement home authority would root out those bad apples and get them to clean up their act — or shut them down.&#8221;</p>
<p>Valentine said the focus is on homes with the worst complaints. But seniors’ advocate Judith Wahl argues that many troubled homes fly under the radar because residents do not speak up.</p>
<p>&#8220;A lot of people don’t know their rights or they are afraid to say anything,&#8221; said Wahl, of the Advocacy Centre for the Elderly.</p>
<p>&#8220;When you are frail and have care needs, it’s very challenging to make an effective complaint,&#8221; Wahl said. &#8220;But just because a home hasn’t had complaints doesn’t mean it’s a good place.&#8221;-www.thestar.com</p>

INFO &#8211; A new Health Council of Canada report on the state of home-care services for senior citizens nationwide describes how many people caring for their loved ones with complex and multiple health needs at home are in distress because they are not receiving enough support from the public system.</p>
<p>“You cannot, cannot do this alone. It’s absolutely insane to think that you can do this alone,” said Southon, a former teacher who is currently developing a dementia care mentoring business. “If you’re not looking after yourself, you can’t look after anybody else.”</p>
<p>The report from the independent agency funded by Health Canada commissioned analyses of data gleaned from assessments by home care professionals in five regions — including 2010 data from Ontario — on ongoing longer-term home care clients aged 65 and up.</p>
<p>The analyses showed that in Ontario family caregivers devote an average of 18 hours per week to caring for their loved one, compared to seven hours per week from home care services.</p>
<p>Family caregivers increase their weekly hours along with the needs of their loved ones — with family caregivers in Ontario devoting an average of nearly 30 hours per week caring for those with physical disability, cognitive impairment, challenging behaviour, wandering and falls.www.thestar.com</p>

<p>Television host Dick Clark has died from a heart attack. According to reports from <a href="http://www.tmz.com/2012/04/18/dick-clark-dead-heart-attack/#.T48aaDJSQyd">TMZ </a>and <a href="http://www.chicagotribune.com/entertainment/ktla-dick-clark-dead,0,5745619.story">KTLA</a>, a station based out of LA, have reported that he suffered from a heart attack this morning.</p>
<p>Clark is survived by his his third wife, Karing Wigton and his three children.</p>
<p>Clark was the host of US TV&#8217;s longest running music show <a href="http://en.wikipedia.org/wiki/American_Bandstand"><span><em>American Bandstand</em></span></a><em> (</em>1952 &#8211; 1989). He also hosted <a href="http://en.wikipedia.org/wiki/Dick_Clark%27s_New_Year%27s_Rockin%27_Eve_with_Ryan_Seacrest#2011"><span><em>Dick Clarks New Year&#8217;s Rockin&#8217; Eve</em></span></a>. In 2006, Ryan Seacrest came on as his co-host.</p>

<p>Up to 300 delegates are expected to attend the Summit, where all stakeholders &#8211; consumers, care givers and health professionals, along with educators, provincial, territorial and federal government representatives, business and not-for-profit groups will be able to provide valuable input to the National Pain Strategy for Canada.</p>
<p>During the summer of 2010, the CPS developed a draft National Pain Strategy and this document was the focal point of a Stakeholder Forum held on September 16, 2011 in Toronto. A cross-section of 50 stakeholders attended the Forum and provided critical input to the draft strategy.</p>
<p>The National Pain Strategy is a document which would work to ensure that health care professionals have more training in pain management, are aware of alternative treatment options and ensure that all Canadians have equal access to the medical attention they require. The National Pain Strategy for Canada will be presented at the Canadian Pain Summit in April 2012 for final consideration and acceptance by all participants.</p>
<p>Given the magnitude and scope of the problem of under treated pain in Canada, a national strategy along with an associated Summit is the best way to proceed. A great deal was learned from the International Pain Summit held in September 2010 in Montreal, Quebec and the CPS and CPC want to continue to improve the situation for all Canadians living with pain.</p>

<p>INFO / BIO-  Dr Clark is currently the Medical Director, Pain Services, Capital Health and Professor of Anesthesia, Dalhousie University, Halifax, NS.  He was Medical Director of the Calgary Chronic Pain Centre, Alberta Health Services and Professor of Anesthesia at the University of Calgary from 2004 to 2009.</p>
<p>He received his MD from Dalhousie University and completed post-graduate training in Winnipeg and Ottawa.<br />
He is a Past President of the Canadian Pain Society and has served as Secretary of the Canadian Anesthesiologists Society.</p>
