Lawyers for Bill Cosby have asked the Pennsylvania Supreme Court for another chance to have the comedian’s criminal sex assault case thrown out.

The defence is arguing that the current district attorney – can’t go back on the word of a predecessor – who says he promised Cosby wouldn’t be charged in the case.

The lawyers say Cosby relied on that pledge when he testified in a related lawsuit –  about his contact with some of the women accusing him of sexual assault.

The entertainer was charged last year with felony sexual assault – after his deposition in the decade-old case became public.

Cosby is 78. He’s been free on $1 million bail since his arrest in December. He denies the allegations.

A preliminary hearing is scheduled for May 24th – unless his appeal is granted by the Supreme Court.
