Some of Ontario’s biggest insurance companies are facing proposed class action lawsuits – alleging that they are failing to properly pay H-S-T on accident benefits.

Lawyers representing automobile accident victims say that breaks the rules governing payments to accident victims – and decreases funds available over the long term – for help in their recovery.

Ontario’s insurance regulator – the Financial Services Commission of Ontario – is also named in the legal action – for allegedly knowing about the practice for years but failing to stop it.

The lawsuits are seeking $600 million dollars – but none of the allegations against Aviva, Intact, Belair, Allstate, Unifund and Certas – have been proven in court.
