ONTARIO TAKING LEGAL FIGHT OVER CARBON TAX TO SUPREME COURT

Just days after Premier Doug Ford indicated his government would wait until after the election in October before deciding whether to proceed with its legal challenge of the federal carbon tax, the province has announced it will take its fight to the Supreme Court.
Environment Minister Jeff Yurek says the government is asking the high court to overturn a decision from Ontario’s Court of Appeal in June that found the Greenhouse Gas Pollution Pricing Act is within Ottawa’s jurisdiction to legislate matters of ”national concern.”
The province claims the carbon charge is an illegal tax and violates the Constitution because it allows the federal government to intrude on provincial jurisdiction.
Ontario, Saskatchewan, Alberta, Manitoba are all in the midst of legal challenges opposing the carbon tax.
