Jim Karygiannis has lost his Ward 22 Scarborough-Agincourt council seat a second time.
A panel of three justices from Ontario’s Court of Appeal has overturned an earlier decision.
Karygiannis was first removed last November after his campaign statement showed he’d overspent the limit in the 2018 municipal election.
But he was reinstated soon after a Superior Court judge agreed with the councillor that an error in campaign paperwork had been made ”inadvertently.”
In the latest ruling however, the province’s high court says the Superior Court did not have jurisdiction to reinstate Karygiannis and that he ”has not clearly demonstrated” that the spending was merely a clerical mistake.
